Popeyes Privacy Policy

This Privacy Policy describes the types of Personal Information that Popeyes Louisiana Kitchen, Inc. (“PLKI”, “we”, or “our”) collects from and about you when you make a purchase on our Cajun Turkey website (the “Site”), and how we may collect, use, disclose, and otherwise process Personal Information.  Please read it carefully to learn your choices and legal rights with respect to such Personal Information.

When you place an order or otherwise submit information through the Site, you agree to the collection, use, and disclosure of your information as described in this Privacy Policy and to our Terms of Service, which are incorporated by reference. Please review them carefully before using the Site. If you do not agree, you may choose not to proceed with an order or submit information

As further described in the “Information Use” section below, we generally collect and use the above-listed categories of Personal Information to provide and manage the Site, fulfill our contractual obligations to you, and achieve legitimate business or commercial purposes. 

We retain each category of Personal Information that we collect for as long as necessary to fulfill the purposes described in this Privacy Policy, including to satisfy legal or reporting requirements.

We do not use Sensitive Personal Information for purposes other than those permitted by applicable law. Payment information is processed exclusively through PCI-compliant third-party payment providers and is not stored by PLKI.

1. INFORMATION WE COLLECT

There are several ways we may obtain information about you, including through (A) information you provide to us directly through both online and offline interactions; and (B) information that we automatically collect when you visit our Site. This includes data that identifies you personally, whether directly or indirectly.

When information identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with you or your household, we refer to it as “Personal Information.”

A. Information You Provide

We collect information from you when you or someone acting on your behalf choose to share it with us. This may include when you provide Personal Information in connection with the Site; contact us with questions or to provide feedback; subscribe to our mailing lists or otherwise agree to receive marketing communications from us; or when you interact with us offline through in-person interactions. This includes:

  • Identifiers, such as your first and last name, address, email address, phone number, or other similar identifiers you provide to the Site; your IP address; your user ID; and your first name, email address, and Popeyes Rewards Loyalty ID (if you have one).
  • Any Personal Information described in subdivision (e) of Section 1798.80 of California Civil Code, including your telephone number.
  • Other information you provide to us, such as your interests and any other materials, information, and content that you choose to submit to the Site.
  • Inferences, which is new information that we generate about your likely preferences, hobbies, interests, or other characteristics from any of the categories of Personal Information outlined above.

B. Information Automatically Collected

Whenever you interact with the Site, we, as well as third-party advertisers and/or service providers, may use cookies, web beacons, pixel tags, or other technologies to automatically or passively collect information about your online activity. As you interact with our Site, we may automatically collect technical information about your device as well as usage information through these and other similar technologies. We may also collect certain information through these technologies when you visit other websites. This includes:

  • Internet or other electronic network activity information, including internet browsing history, search history, interactions with the Site and advertisements, web browser type and version, device characteristics, operating system, IP address, Popeyes Rewards Loyalty ID (if you have one), or other online identifiers.

We may also use third-party analytics and tracking tools to better understand who is using our Site, how people are using the Site, and how to improve the effectiveness of the Site. We may also use these tools to help us or our third-party partners and providers serve more targeted advertising to you across the Internet. These tools may include cookies, pixel tags, or similar technologies that automatically collect and store certain Personal Information about you with the Site.

C. Combination of Information 

We may combine the various types of information we collect about you and use it as described in this Privacy Policy.

If you refuse to provide any requested information (whether or not required), you may not be able to take full advantage of the Site and its features.

2. INFORMATION USE

We may use the Personal Information we collect for a variety of business or commercial purposes, including:

  • Administering and operating the Site, including processing orders and providing customer service.   
  • Marketing. We may communicate with you about our products and promotions, subject to applicable legal requirements and your marketing preferences. This includes delivering, measuring, and auditing marketing, promotions, and offers, and providing other advertising services.
  • Communicating with you. We use Personal Information (e.g. your contact information) to respond to questions or comments when you communicate with us through links or pages in the Site, and to send you administrative information (e.g. information regarding the Site and changes to our terms, conditions, our Privacy Policies, and other policies).
  • Performing analyses. We may use your Personal Information to perform business analyses or for other purposes designed to improve the quality of our business and the Site.
  • Preventing and detecting fraud and other crimes. We may use your Personal Information to help prevent and detect fraud and other crimes that might be committed using or against the Site and other websites or mobile apps we offer. We may use your Personal Information to investigate possible violations of and enforce our contracts. We may use your Personal Information to protect our or others’ rights, privacy, safety or property, and/or that of our affiliates. We do this to protect our business assets and to comply with our legal obligations. 
  • Managing and operating our IT systems. We use your Personal Information to help us in troubleshooting, testing, maintaining, and protecting our IT systems, including the Site and other websites or mobile apps we offer.
  • Complying with legal and regulatory obligations. We may use Personal Information to comply with our legal and regulatory obligations, which arise from time to time.
  • Aggregating and/or anonymizing Personal Information. We use Personal Information you provide to us regarding the Site to provide product feedback to our customers in aggregate form. We may also use Personal Information in an aggregated non-specific format for analytic and demographic purposes.

Additionally, we may use your Personal Information for other purposes disclosed at the time you provide your information or otherwise with your consent.

3. HOW WE DISCLOSE INFORMATION

We may disclose Personal Information with the following categories of entities:

  • Service Providers: We disclose your Personal Information with service providers that provide business, professional, or technical support functions to help us operate the Site.
  • Analytics and Advertising Partners: We may use third party analytics and tracking tools to better understand who is using or how to improve the effectiveness of the Site and related content, and to help us serve relevant advertising to you. We may use analytics tools provided by Google to help us understand how people use the Services. If you wish to prevent your data from being used by Google Analytics, Google has developed the Google Analytics opt-out browser add-on available here.
  • Business Partners: We may disclose your Personal Information with companies with whom we partner to offer goods or services (e.g., joint products or promotions).
  • Sponsors or Administrators: We may disclose your Personal Information to third-party sponsors or administrators of sweepstakes, contests, and similar promotions.
  • Legal Matters: We may disclose your Personal Information to respond to judicial processes or government requests and investigations, as permitted by law, or otherwise as required by law. We also may disclose your Personal Information to enforce our rights, prevent fraud, and protect the security of our servers, Site, and databases.
  • Sale or Transfer of Business or Assets: If another entity purchases or acquires our business or any of our assets, Personal Information we have collected about you may be transferred to such entity. Should such a sale or transfer occur, we will use reasonable efforts to try to require that the transferee use information provided through the Site in a manner that is consistent with this Privacy Policy.
  • Other Third Parties: We may disclose your Personal Information when we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, including to allow us to pursue available remedies and limit the damage we may sustain. We may also disclose your Personal Information with other third parties in certain circumstances. We will explain these circumstances to you at the point of information collection and, where we deem legally necessary, get your permission.
  • Aggregated or de-identified information: We may also disclose aggregated or de-identified information that does not meet the definition of “Personal Information,” above.

Explanation of Applicable Privacy Rights

The rights described below are available to the extent provided by applicable law, which may vary depending on your U.S. state of residence.  Depending on your U.S. state of residence, you may take advantage of the following rights:

  • Right to Know, Confirm Processing, and to Access: You have the right to confirm that we are processing your Personal Information, and to request that we provide you with what Personal Information we have collected about you, including the categories of Personal Information; the categories of sources from which the Personal Information is collected; the business or commercial purpose for collecting, selling, or sharing Personal Information; what Personal Information is used for advertising; the categories of third parties to whom we disclose Personal Information; and the specific pieces of Personal Information we have collected about you. You have the right to receive this information in a portable format.
  • Right to Delete: You have the right to request that we delete Personal Information that we have collected from you, subject to certain exceptions. Note that there are some reasons we will not be able to fully address your request, such as if we need to complete a transaction for you, to detect and protect against fraudulent and illegal activity, to exercise our rights, for our internal purposes, or to comply with a legal obligation.
  • Right to Correct: You have the right to request that we correct inaccurate Personal Information that we may maintain about you, subject to appropriate verification.
  • Right to Opt-Out of the Sale or Sharing of, or Targeted Advertising using, Personal Information
  • Right to Request a List of the Specific Third Parties to Which We Have Disclosed Your Personal Information.
  • Right to Limit: You have the right to request that we limit the use and disclosure of your Sensitive Personal Information.
  • Right to Appeal: You may also have the right to appeal a denial of your privacy rights.
  • Right to Nondiscrimination. You have a right to not be discriminated against for exercising any of these rights.

How to Submit a Request

  • Depending on your U.S. state of residence, to take advantage of your rights listed above, please contact us by email at privacy@rbi.com, or by using the “How to Contact Us” section below. If by email, please indicate the type of request you are making in the subject line of your message. We may request certain information to verify your identity before we can respond to such requests. We will confirm receipt of your request within ten (10) business days and will respond to your request within forty-five (45) calendar days, after proper verification, unless we need additional time, in which case we will let you know.
  • You may also choose to enable online, where available, a universal opt-out preference via a tool that automatically communicates your opt-out preferences, such as the Global Privacy Control (“GPC”). We will process the GPC signal as a request to opt out of any sales of your Personal Information or targeted advertising.

Agent Requests

  • You may authorize someone to make a privacy rights request on your behalf (an authorized agent). Authorized agents will need to demonstrate that you’ve authorized them to act on your behalf or must demonstrate they have power of attorney pursuant to applicable probate law. We retain the right to request confirmation directly from you confirming that the agent is authorized to make such a request, or to request additional information to confirm the agent’s identity and authority to make such a request. We will not use a consumer’s Personal Information, or any information collected from or about the consumer, or an authorized agent, for any purpose other than to fulfill the consumer’s requests, for verification, or for fraud prevention. If you are making a request as an authorized agent, please contact us using the information in the “How to Contact Us” section below, and provide your full name, address, email address, the full name of the person on whose behalf you are making the request, their address, email, phone number, as well as the written permission of the person on whose behalf you are acting to do so.

California-Specific Data Protection Disclosures

  • In the past 12 months, we have collected the categories of information disclosed above in the “Notice at Collection” section and disclosed those categories for the business purposes also referenced in the “Notice at Collection” section.
  • As noted in the “Notice at Collection” section above, certain categories of Personal Information collected through the Site have been “sold” or “shared” as those terms are defined under applicable California law, while other categories have not. We do not knowingly “sell” or “share” Personal Information about persons under the age of 16.
  • Use and Disclosure of Sensitive Personal Information: To the extent that we collect, use, or share “Sensitive Personal Information” as that term is defined in applicable California law, we limit our use or disclosure of the Sensitive Personal Information to permitted business purposes.

5. REQUESTS REGARDING YOUR INFORMATION

To make any request with respect to your Personal Information processed on the Site (e.g., request to access, request to delete), please submit your request to us at privacy@rbi.com.  In your email, please reference the Site and the nature of your request. We will fulfill your request within a reasonable timeframe, in compliance with applicable laws.

You may authorize someone to make a privacy rights request on your behalf (an authorized agent). 6. THIRD-PARTY LINKS AND FEATURES

The Site may have links to third-party websites, applications, and other interactive features, which may have privacy policies that differ from our own. Please review those privacy policies carefully.

7. COOKIES

The Site may use cookies, social media pixels, and similar technologies to improve your experience using the Site. We and our service providers use the information collected through these technologies to operate the Site, deliver marketing, and perform analytics to improve the Site. We also recognize certain universal opt-out preference signals, such as the Global Privacy Control, as described in the “Your Privacy Rights” section. 8. CHILDREN’S PRIVACY

Protecting children’s privacy is important to us. We do not knowingly collect any Personal Information from children under the age of sixteen (16).

9. NOTICE OF FINANCIAL INCENTIVE

To provide the Site, we collect Personal Information, which may be interpreted as a “financial incentive” program or “bona fide loyalty program” under applicable law. We use this Personal Information for the purposes described above under the section titled “Notice at Collection,” including for advertising. We may disclose your Personal Information to other parties as described in our “How We Disclose Information,” including data analytics and advertising providers.

The value of your Personal Information collected via the Site is reasonably related to the value of the perks, benefits, or discounts that may be made available to you via your participation in the Site. We estimate the value of your Personal Information by considering, without limitation, the expenses we incur from collecting your Personal Information and/or providing the financial incentive to you, the revenue generated by your use of the financial incentive, and any improvements we can make to our products and services based on aggregating information obtained through the financial incentive program.

10. DATA SECURITY

We take reasonable and appropriate physical, administrative, and technical steps to safeguard the Personal Information we collect from and about our customers and users of the Site. However, no security system is perfect, and we cannot guarantee the absolute security of your Personal Information.

11. DATA STORAGE

Your Personal Information is stored on servers in the United States. 

12. INFORMATION RETENTION

We will retain your Personal Information as long as necessary to fulfill the purposes outlined in this Privacy Policy, including to satisfy our legal or reporting requirements, unless a longer retention period is required or allowed under law.

To determine the appropriate retention period for Personal Information, we consider the amount, nature, and sensitivity of Personal Information; the potential risk of harm from unauthorized use or disclosure of the Personal Information; the purpose for which we use the Personal Information; whether we can achieve the purposes through other means; and the applicable legal requirements.

If we de-identify Personal Information, we will maintain and use the information in de-identified form and not attempt to re-identify the information except as required or permitted by law.

13. REVISIONS TO THIS PRIVACY POLICY

We may revise all or portions of this Privacy Policy at any time. When we do, we will post the change(s) on the Site. At the top of this Privacy Policy, you can find the date that we last updated the policy. Your continued use of the Site following the posting of changes means you accept those changes. If we change the Privacy Policy in a material way, we will provide appropriate notice to you.
